About Adoption in China

 

Adoption is a legal action of adopting other person's child according to the conditions and procedures stipulated by law, making non blood-related persons parent-children relationship.

 

1. Foreigner adopts a Chinese child in China.

1) The responsible Organization

According to the relative regulations, China Center of Adoption Affairs of the Ministry of Civil Affairs (log on the website) is responsible to assist foreigners to adopt Chinese children in China.

The adoption of Chinese child by any foreigner should be conformed to the related Chinese Adoption Laws. The native country of the adopter should recognize the related adoption between the adopter and the Chinese child, which was settled by the Chinese Law in China. No further procedures of adoption should be gone through after the adopter return to his/her country.

The application of foreign adoption must be submitted by the National Government of the adopter, or the adoption agency authorized by the government, to the "China Center of Adoption Affairs" authorized by the Chinese Government.

2) The required documents

1. Application of adoption

2. Birth Certificate of adopter

3. Certificate of the adopter's Marriage Status

4. Reports of the adopter's Occupation, Financial Status and Properties.

5. Adopter's Health Certificate

6. Adopter's No Criminal Record Certificate

7. The certificate of adoption agreement issued by the relative government agent of the adopter's native country.

8. Report of the adopter's family Status.

All the above documents are necessary to apply for Notarization and Authentication in South Africa, as well as the Authentication issued by the Chinese Consulate General.

 

2. A South African Chinese adopts a Chinese child in China

The required documents

1. Adopter's passport

2. Adopter's Birth Certificate

3. Certificate of the adopter's Marriage Status

4. Reports of the adopter's Occupation, Financial Status and Properties.

5. Adopter's Health Certificate

6. Adopter's No Criminal Record Certification

All the above documents are necessary to apply for Notarization and Authentication in South Africa, as well as the Authentication issued by the Chinese Consulate General.

 

3. Adoption between South African Chinese

In such case, all the procedures and required documents would be bound by the South Africa Jurisdiction.
